Terms and Conditions

Booking a private villa at Alaya Malai is different from booking a regular hotel room, especially regarding payments and cancellations. We strongly advise against merely checking the box and accepting these terms and conditions without reading them carefully. The Management of Alaya Malai (“The Management”) acts as a wholesaler for property owners (“Owner”) and their representatives (“Owner Representative”). When a guest confirms a booking through The Management, a Rental Contract is entered into between The Management and the guest (“Guest”) for the agreed Rental Period.

The Rental Contract is not effective until The Management has confirmed the booking in writing. By booking a Property through The Management, the Guest agrees to these terms and conditions and consents to the processing of personal data related to the Rental Contract.

Arrival & Departure Times

​

The standard check-in time at Alaya Malai is 2:00 PM, and check-out is at 12:00 PM unless stated otherwise. We aim to accommodate your arrival and departure times, subject to availability. Please notify us of any changes to your schedule to allow us to assist where possible. Early check-in and late check-out are subject to availability and require an additional fee.

Payment

​

Full payment is required to confirm your reservation.

Security Deposit

​

A refundable security deposit of RM100 is required upon check-in to cover potential damages or extra cleaning costs. We kindly request guests to treat the villa with care during their stay.

Additional Costs

​

The rental rates include electricity, water, cleaning, garden supplies, and local taxes. No additional costs, such as management fees, are incurred unless stated in the booking confirmation. Any provisioning costs are the guest’s responsibility. Gratuities for staff are optional and at the guest's discretion.

Cancellation & Postponement Policy

​

  • Cancellations must be made at least 3 days before the check-in date for a full refund.

  • Cancellations made within 3 days will incur a fee of 10% of the total reservation cost.

  • No refunds will be given for no-shows or early departures.

  • Refunds take approximately 7–20 working days to process and include a transaction fee (3% for Visa/MasterCard, 5% for American Express).

Damage & Losses

​

Alaya Malai is our pride and joy. Guests are responsible for ensuring the property and its contents remain in good condition. Any damages or extra cleaning due to negligence will be charged. Excessive damage may result in immediate eviction without compensation.

Access

​

While you have full access to Alaya Malai during your stay, occasional maintenance may require staff or contractors to access the property. We appreciate your understanding in these situations.

​

Guest Limit

​

The maximum capacity is stated in the booking confirmation. Exceeding the limit without prior approval may result in restricted access or invalidation of your booking.

​

Property Use

​

Bookings are for leisure purposes only. Events such as weddings or gatherings must be approved in writing before confirmation. Note that certain events may require additional fees, security deposits, or permits.

Conduct & Safety

​

Please maintain a respectful environment during your stay. Illegal or immoral activities are strictly prohibited. Guests are responsible for supervising children around the property and ensuring the safety of all party members.

Valuables & Security

​

Guests are responsible for their belongings. Alaya Malai is not liable for any loss or damage to personal items. Please ensure doors and windows are securely locked when leaving the villa.

Price & Amendments

​

Once a booking is confirmed, the quoted price is guaranteed. Any government-imposed taxes or charges unknown at the time of booking will be communicated promptly.

Complaints

​

Should any issues arise during your stay, please inform us immediately to resolve them promptly. Complaints raised after check-out will not be entertained.

Alaya Malai Responsibility

​

While we ensure accurate descriptions and information, unforeseen changes may occur. Alaya Malai will not be held liable for events or inaccuracies beyond our control.

​

Disclaimers

​

Alaya Malai is not responsible for injuries, losses, or disruptions caused by external factors, including travel delays or force majeure events. Our liability is limited to the total rental amount paid.

​

Jurisdiction

​

This agreement is governed by Malaysian law. Any disputes will be resolved through arbitration at the Asian International Arbitration Centre (Malaysia).

By confirming your booking, you acknowledge and accept these terms and conditions.
